By accessing or using the Botson platform, including our website, Adobe Illustrator plug-ins, and related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users of the Service, including account holders, team members, and end users accessing the proofing portal.
Botson provides printshop workflow tools, including but not limited to preflight automation, proof management, customer proofing portals, and Adobe Illustrator plug-ins. The Service is offered on a subscription basis with various tiers as described on our pricing page.
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Botson may offer a free trial period for new accounts. At the end of the trial period, your account will require an active subscription to continue using the Service. Subscription fees are billed in advance on a recurring basis according to the plan you select. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period.
You agree not to:
The Service, including all software, designs, text, graphics, and other content, is the property of Botson and is protected by copyright, trademark, and other intellectual property laws. You retain all rights to the files, artwork, and content you upload to the Service. By uploading content, you grant Botson a limited license to store, process, and display your content solely for the purpose of providing the Service.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We may also update these Terms from time to time, and continued use of the Service after such changes constitutes your acceptance of the revised Terms.
To the fullest extent permitted by law, Botson shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. In no event shall our total liability exceed the amount you paid to Botson during the twelve (12) months preceding the claim.
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that defects will be corrected.
We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the Service will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
